The real estate practice of our firm has been recognized as one of the leading in Sofia. Although the successful resolution of our clients’ restitution problems has resulted in diminishing of the importance of this practice, the insightful knowledge of the Bulgarian real property legislation and case law is extremely helpful in handling complex mergers and acquisitions or property development projects.

Restitution and other common real property issues

The package of restitution laws and secondary legislation adopted in the early 1990-ies and regularly overhauled throughout the decade have revolutionary changed the fundamentals of the real estate in Bulgaria. We have narrowly followed this process by being involved in hundreds of unique predicaments, disputes, and litigations. Today, the analysis of passed or still pending restitution disputes is an indispensable part of any due diligence investigation.

It is typical for the property transactions in Bulgaria to involve common real property problems, such as inheritance and family law issues; impact of past planning changes; defects in the Notary Deeds; existing/terminated rent or agricultural lease agreements, etc. We are well prepared to deal with all these issues, as they are perfectly known to us from our 20-year general practice experience.

Investment & development

The rapid development of the Bulgarian real estate marketplace requires competent legal advice on the purchase, sale, financing, leasing, and development of real estate property of all types. Our real estate practice advises international clients on landmark development projects: large shopping centres; mixed (commercial+shopping+residential) urban projects; unique culture monuments’ reconstruction; green-field industrial ventures.

We cover all relevant subjects: we are equally effective when assisting our clients in structuring, negotiating and documenting the purchase or in the project financing, planning permission proceedings, construction, and commercial property management.

Due to the specifics of the procedures for changing the purpose of agricultural land to industrial, we currently do not provide such services.

Spatial Planning

Spatial planning is one of the most complex fields of our expertise. Starting from the clear understanding of the legal procedures, we have gradually gained significant technical knowledge as well, working in narrow cooperation with one of the leading Bulgarian design bureaus. In addition to the legal and technical expert knowledge, however, this field also requires effective interest representation before the municipal self-governing bodies which are competent to decide on the urban development of the respective area. Carried out in an open and transparent way, with honesty and integrity, the activities aimed at influencing the policy consideration and decision-making of the local authorities are vital for the success of any large-scale property development project.

Our spatial planning services include assisting in issuing of planning permission; drafting and negotiating design agreements; environmental impact assessment; coordination procedures with the utilities; resolving possible heritage issues with the National Cultural Monuments Institute. In the cases of public infrastructure projects, we also provide advice on land expropriations, evaluations, and appealing before the competent administrative court.
